As “Special Counsel” to our firm, David Augustus Garcia represents management and small business and mid-size entrepreneurs in all aspects of commercial and employment litigation. He has experience defending employers and management in claims brought under the Fair Employment and Housing Act, Title VII, Americans with Disabilities Act, Age Discrimination in Employment Act, Family Medical Leave Act, the Employee Retirement Income Security Act, and California Wage and Hour Laws.
Mr. Garcia also has experience defending employers in wage and hour class actions including claims for overtime violations, meal and rest period violations, waiting time penalties, the Motor Carrier Act Exemption and other purported wage and hour violations. |

Mr. Garcia advises clients regarding various personnel policies and procedures, employee discipline matters, employee handbooks, wage and hour issues, and other employment issues. Mr. Garcia is fluent in Spanish, and he regularly conducts employee training and investigations in Spanish at the workplace.
Mr. Garcia served in the United States Marine Corps from 1990 to 1994, and is a veteran of the Persian Gulf War. Mr. Garcia received his law degree from the University of California, Berkeley Law School in 2001 and received his Bachelor of Arts degree, cum laude, from the University of California, Los Angeles.
Mr. Garcia is admitted to practice before California courts and a number of federal district courts. |
