Salvatore Picariello has represented clients in a broad range of business litigation matters in both federal and state court, including actions involving unfair competition, business torts, RICO, insurance bad faith, contract disputes, and fraud. Mr. Picariello has also assisted in the representation of debtors and other parties in interests in adversarial proceedings in bankruptcy court.

While at the international law firm of Morgan, Lewis & Bockius LLP, Mr. Picariello practiced for several years in the labor and employment group, which is a five-time winner or finalist in The American Lawyer Magazine's Litigation Department of the Year - Labor and Employment Law. Mr. Picariello represented employers in all aspects of labor and employment litigation, including wrongful termination, employment discrimination, sexual harassment, retaliation, employment torts, and wage and hour class actions.

Prior to joining Morgan Lewis, Mr. Picariello was associated with the international law firms of Brobeck, Phelger & Harrison LLP (now defunct) and Morrison & Foerster LLP, where he worked in the complex commercial litigation and labor and employment departments, respectively.

Before entering private practice, Mr. Picariello served as a law clerk to the Honorable Robert E. Cowen on the United States Court of Appeals for the Third Circuit from 1997-1998, and he served as a law clerk to the Honorable Garrett E. Brown, Jr., for the United States District Court for the District of New Jersey. While attending law school, Mr. Picariello also worked full-time as a whistleblower investigator for the United States Department of Labor-OSHA. He was also a member of the Seton Hall Law Review for three years and served as an Articles Editor in 1993-1994.

Mr. Picariello is admitted to practice in all state and federal courts in California and New Jersey, the United States Court of Appeals for the Ninth Circuit, and the United States Court of Appeals for the Third Circuit.
Selected past representations have included:

  • A $44.6 million jury verdict for a sports agency in the Central District of California on trade secrets claims.
  • Summary judgment for an international pharmaceutical company in Los Angeles Superior Court on claims of harassment, discrimination, and retaliation.
  • Judgment on the pleadings for an international shipping company in Los Angeles Superior Court, resulting in dismissal of the plaintiffs' class action claims.
  • Reversal on appeal of judgment entered in contract dispute, resulting in published opinion by California Court of Appeal in Newport Beach Country Club, Inc. v. Founding Members of Newport Beach Country Club, 140 Cal. App. 4th 1120 (2006).
